NEW: Brad Schimel Asks ‘What Is Flawed?’ About 1849 Law; Claims ‘There is Not a Constitutional Right to Abortion’ In Wisconsin


MADISON, Wis. – In case you missed it, The New York Times reported on a recently uncovered audio of extreme politician Brad Schimel pre-judging how he would rule in abortion cases.


In two separate audio clips from last year, Schimel said that “there is not a constitutional right to abortion” in Wisconsin. Schimel also exclaimed on the 1849 law that bans all abortions with no exceptions, “What is flawed about that law?”


While Judge Crawford was fighting to protect fundamental rights, Brad Schimel was arguing in favor of Wisconsin’s 1849 abortion ban, argued to keep it on the books, and defended abortion restrictions. Even now, he’s called the 1849 ban "valid." And under Schimel, the Wisconsin Department of Justice played a leading role in the national effort which successfully overturned Roe v. Wade.

  • The race, like many others in Wisconsin, is likely to be dominated by abortion rights.


  • As attorney general, Judge Schimel helped map out a strategy to restrict abortion rights. And last summer, in the early stages of his campaign for the court, he told supporters he backed the state’s 1849 law banning abortion, which became valid when the U.S. Supreme Court overturned Roe v. Wade in 2022. The old law was put on hold in December 2023 and is likely to come before the state high court later this year.


  • “They’ve got several issues in front of them,” he told a crowd in Adams County, according to audio of the meeting shared with The New York Times. “One is the 1849 ban on abortions, which, by the way — what is flawed about that law?”


  • At another stop, in Chilton, Wis., Judge Schimel declared: “There is not a constitutional right to abortion in our State Constitution. That will be a sham if they find that.”

Call to Action: Contact the JFC about cuts to higher ed

We have received and urgent call to action from our area Democratic legislators, though the urgency is state-wide.   Robin Vos and the Republican members of the Joint Finance Committee are threatening to cut $87 million from the Universities of Wisconsin. This is not only unconscionable given the state’s 4.3 billion surplus it would be catastrophic to the state in many ways. Vos is citing “political correctness” and “lack of political diversity on campuses” as a reason for considering the cuts.   It is imperative you send an email to each of the Joint Finance Committee members urging them not to take this action. Save the Fox Campus

As part of the North OAT’s efforts to get involved in important community affairs, we are asking you to take action to help save some valuable resources that are being threatened by the closure of the UW-Fox Valley campus in June.  It’s sad enough that folks are losing jobs and students are losing a local educational resource but the future of so many popular facilities connected to the campus is suddenly in doubt as well. That includes the Barlow Planetarium (27,000 visitors, including 18,000 students); the Arts Center which houses the Black Box Theatre and which serves as valuable space for 17 community groups; The Earth Science Museum (15-20,000 public school visitors last year); the Children’s Center which will mean the loss of yet another already scarce childcare facility; the Community Garden and so much locally produced fresh food; and so much more.
